LumineCore Limited, a limited liability company registered in the Republic of Cyprus under registration number HE 466730, having its Registered Office at Griva Digeni, 49, Chrystall Court, Floor 5, Flat/Office 51, 6036, Larnaca, Cyprus and its Correspondence Address at Aerotrust Secretarial Limited, Antheon, 13, Aradippou, 7103, Larnaca, Cyprus (referred to as the "Company", "we", "our", or "us"), provides the WithYou mobile application and its related services (the "App").

1. Acceptance of Terms

By downloading, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use and our Privacy notice. These Terms constitute a legally binding agreement between you and the Company. If you do not agree to these Terms, you must immediately cease all use of the App.

2. Eligibility

2.1. Age Restriction: You represent and warrant that you are at least 18 years of age (or the age of majority in your jurisdiction) and have the full legal capacity to enter into this agreement.

2.2. Verification: We reserve the right to implement third-party identity verification to ensure compliance with age restrictions at any time.

3. Services and Accounts

3.1. AI Interaction: The App provides an AI chat service with fictional characters ("Companions") for conversation and creative storytelling.

3.2. Account Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

3.3. Zero-UGC Policy: Users are strictly prohibited from uploading personal media files (photos, videos) for use in conversations or character creation. All interactions and character creations must occur using the proprietary tools provided by the Company.

4. Purchases, Subscriptions, and Pulses

4.1. Subscriptions and Pulses: The App offers periodic subscriptions and a virtual currency called "Pulses", used for specific AI features. Pulses can be purchased as standalone top-ups at your discretion. Pulses have no cash value and cannot be exchanged for money.

4.2. Google Play Billing: All purchases in the App are processed by Google Play and are subject to Google Play's terms and policies. Prices are shown in the App before you confirm a purchase.

4.3. Renewal and Cancellation: Subscriptions renew automatically at the end of each billing period until you cancel them in Google Play › Subscriptions. Cancelling stops future renewals; access continues until the end of the period already paid for.

4.4. Refunds: Refund requests for purchases made through Google Play are handled under Google Play's refund policies.

5. Intellectual Property

5.1. Company Ownership: LumineCore Limited retains all right, title, and interest in and to the App, AI models, and all AI-generated outputs (text, images, videos, voice).

5.2. User License: You are granted a non-exclusive, non-transferable, revocable license to interact with and view AI-generated content for personal, non-commercial use only.

6. Acceptable Use and Conduct

6.1. Safety Guardrails: You agree not to generate or solicit sexually explicit content, content involving the sexualization of minors, non-consensual imagery, extreme violence, harassment, or illegal acts.

6.2. System Abuse: You shall not attempt to reverse-engineer AI models, scrape data, or bypass the App's security or safety filters.

7. Disclaimers and Limitation of Liability

7.1. "As-Is" Basis: The App is provided on an "as-is" and "as-available" basis without warranties of any kind.

7.2. Fictional Nature: All Companions are entirely fictional and AI-generated. Any resemblance to real persons is coincidental. Companions are not a substitute for professional advice, therapy, or emergency services. The Company is not responsible for the emotional or psychological impact of AI interactions.

7.3. Limitation of Liability: To the maximum extent permitted by Cyprus law, LumineCore Limited shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App.

8. Termination and Account Deletion

8.1. Breach of Terms: We reserve the right to suspend or terminate your account at our sole discretion if we suspect a violation of these Terms.

8.2. No Refunds upon Termination: If your account is terminated for breach of conduct, you forfeit all rights to a refund for unused Pulses or remaining subscription time, to the extent permitted by applicable law.

8.3. Deleting Your Account: You can delete your account at any time. How to do it and what happens to your data is described on the Account deletion page.

9. Governing Law and Contacts

9.1. Jurisdiction: These Terms are governed by the laws of the Republic of Cyprus. Any disputes shall be subject to the exclusive jurisdiction of the courts of Cyprus.
